America the beautiful
The United States began to invalidate legislation against blasphemy that had been on the books since before the nation’s founding, as well as lawsuits on that basis, in the twentieth century, after it was determined that they violated the American Constitution. “Congress shall make no law establishing an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of expression, or of the press…” says the First Amendment to the United States Constitution. While there are no federal laws prohibiting “religious vilification,” “religious insult,” or “hate speech,” several states do.
The New York Times claimed in 2009 that blasphemy laws existed in Massachusetts, Michigan, Oklahoma, South Carolina, Wyoming, and Pennsylvania.
In 2010, Pennsylvania’s blasphemy statute was declared unconstitutional.
Blasphemy laws dating back to the early days of the United States still exist in some states.
Section 36. Whoever willfully blasphemes God’s holy name by denying, cursing, or contumely reproaching God, His creation, government, or final judging of the world, or cursing or contumely reproaching Jesus Christ or the Holy Ghost, or cursing or contumely reproaching or exposing to contempt and ridicule the holy word of God contained in the holy scriptures shall be punished.
