Why should the distinctions between a “sale agent” and a “listing agent” matter to anyone? Because you’ll need to know what to name the various agents involved in a transaction, particularly if it’s your first time selling or buying a house.

Answer: No, unless you have permission from your current broker. A listing arrangement is an agreement between the broker and the seller. It is not a negotiation between the salesperson and the seller. As a result, the listing is held by the broker. Even if done by the agent who originally received the listing, inducing the seller to cancel one listing and sign another is likely to be a deliberate interference with contractual ties.
Furthermore, the NAR code of ethics 16-20 specifies that agents shall not induce clients of their current firm to cancel exclusive contractual arrangements between the client and that firm prior to or after their partnership with that firm is terminated.
